Welcome to the Standard Terms and Conditions of Business for Premark Property Ltd.
Please read and accept all of the terms and conditions set out below before using our services.
Before becoming a user of Premark Property Ltd, and before reserving any property through Premark Property Ltd, I confirm that I have read, agree and accept the below Terms and Conditions of Business. Any property reservations I may make in the future will be subject to these terms and conditions of business, and any others, which may apply from time to time.
- I understand there is no obligation for me to purchase property through Premark Property Ltd.
- By joining Premark Property and supplying my email address, I give permission to Premark Property to send me property alerts via email. If I have referred a friend through the Premark Property Ltd website, I have obtained permission from that friend for Premark Property Ltd to offer them free membership via email.
- Every endeavour is made to ensure the accuracy of the information on the Premark Property Ltd site and distributed by Premark Property Ltd. I understand that accuracy is not guaranteed and no representations or warranties are made. Premark Property Ltd (which expression shall wherever used herein,extend to any of its partners, directors, employees or representatives) will not be liable for damages arising out of or in connection with the use of any information provided to me whether online, or otherwise in in any electronic or printed format or orally or howsoever. I understand that Premark Property Ltd is not responsible for any errors or omissions and is not liable, directly or indirectly, for any loss whatsoever that may arise from them. Any photographs, illustrations, specifications, plans and sizes, areas and distances only give a general indication of the proposed development. The Developer reserves the right to alter any part of the development. Tables, projections and profit forecasts are for illustrative purposes only. Any particulars provided do not form part of any offer or contract and must not be relied upon as statements or representations of fact. The property details featured on this site are based upon site visits made to the property concerned by representatives of Premark Property Limited and/or from information supplied to the Premark Property Limited by the seller/developer. Any decision made in relation to purchasing goods and/or services as a result of information obtained from the site is my sole responsibility.
- I understand that the purchase prices in the promotional material are correct at time of publication but may be altered at any time prior to the vendor accepting an offer.
- I understand that reservation fees paid to reserve properties are non-refundable but if I proceed to sign a contract to purchase a property introduced to me by Premark Property Limited, the reservation fee will be credited against the purchase price of the property..
- I agree to pay Premark Property Limited a fee of 2% plus G.S.T of the purchase price of the property if I sign a contract to purchase a property introduced to me by Premark Properties Limited. Such fee shall be immediately payable upon the contract to purchase becoming unconditional in all respects.
- Premark Property Ltd is not a regulated or licensed investment or financial advisor. All information provided by Premark Property Ltd is intended as general information regarding property and should never be treated as giving specific advice or recommendations. I understand that I should seek my own accounting, financial and legal advice.
- I understand that I should carry out due diligence before making any decisions based on the information provided. I should not assume that the property has all necessary planning; building regulation or other consents. I also understand that Premark Property Ltd has not tested any services, equipment or facilities. Any particulars or plans provided were prepared from preliminary plans and specifications before completion of the properties and are intended only as a guide. They may have been changed during construction or finishes could vary. I understand that I should not rely on this information but get my solicitor to check the plans and specification attached to the contract.
- Lease details, service charges and ground rent (where applicable) are given as a guide only and should be checked and confirmed by your solicitor prior to making the contract unconditional..
- I understand that historic performance of property and rental values cannot be used as a guarantee of future performance. I understand that property values can decrease as well as increase. I also understand that rental income achieved may not always match that predicted.
- There are links from the Premark Property Ltd site to other internet sites - I understand that Premark Property Ltd is not responsible for the contents of any external internet site.
- I understand that it is solely my own liability to arrange mortgage finance through a third party and I understand that Premark Property Ltd offers no guarantee that I will be offered mortgage lending at any stage in the buying process, from offer to completion. Should I choose to enter into a contract without having obtained a formal mortgage offer, I understand that I may be required to settle in cash on completion or forfeit any deposits paid.
- Mortgage offers are dependent on my financial circumstances at the time of application. I understand that if I do not keep up repayments on my mortgage, any security held against my mortgage may be at risk.
- I understand that Premark Property Ltd cannot be held responsible for specific performance of any third party vendor.
- I understand that Premark Property Ltd is not liable to anyone if interference with, or damage to any computer systems occurs in connection with use of its website or a linked website.
- I understand that Premark Property Ltd may, from time to time, change or add to the Premark Property Ltd website or the information or services without notice.
